Definitions

"Web Waiver" refers to WebWaiver.com or any of the Web Waiver family of web sites.

"Customer Account" or "Customer's Account" refers to an online account setup to use any of the Web Waiver online management tools.

"Customer" refers to any person or entity that has a valid Customer Account with Web Waiver.

"User" refers to any person or entity that has a valid login to a Customer Account with Web Waiver.

General

Customers and Users are subject to compliance with these terms and conditions. Anyone who visits the Web Waiver web site(s) or uses/accesses any of Web Waiver’s applications shall be deemed to have agreed to these terms and conditions.

Customer Account

Customer must provide their full legal name, a valid email address, and valid payment information in order to create a Customer Account. Customer, and Users created under Customer's Account, are fully responsible for the safety and security of Customer's Account detail and any login credentials. Customer, and Users created under Customer's Account, are fully responsible for monitoring, managing, and maintaining any content created or existing within Customer's Account.

You must be 18 years or older to subscriber to this Service. No bots are allowed to register or use this service. You are responsible for keeping your account secure. You are responsible for any content you post on this site. You may not use this service for any illegal or unauthorized purpose. You may not use this service to violate any copyright or trademark laws.

Communication

Web Waiver may communicate with Customer via email or phone regarding issues related to Customer's Account. Web Waiver may communicate with Customer via email or phone regarding issues related to payment and billing. Web Waiver may communicate with Customer or Users via email or phone regarding issues related to support issues.

Billing, Payment, and Refunds for Monthly Accounts

Web Waiver service is billed in advance for each month. Customer's credit card will be billed on their monthly anniversary date. Customer's anniversary date is the order date of their initial subscription. Monthly charges are non-refundable. Customer can cancel at any time. Customer must cancel service prior to the beginning of any given month to avoid charges for that month.

Billing, Payment, and Refunds for Annual Accounts

Web Waiver service is billed in advance for each year. Customer's anniversary date is the order date of their initial subscription. Customer can cancel at any time. Customer will be issued a prorated refund for any full month remaining in the current year of service.

Pricing

Web Waiver reserves the right to change pricing, features, or availability of the service at any time with or without notice. Prices of all services are subject to change at any time with or without notice. Web Waiver shall not be liable to you or any third party for changes to pricing, features, or availability of this service.

Cancellation

Customer may cancel at any time by sending an email to support@WebWaiver.com. Customer must include Customer's name, account number, and email address in order to cancel. Cancellations will be verified and confirmed by Web Waiver's sales team.

Waiver Assistance

Web Waiver provides assistance with setup and creation of online forms for the Customer. Customer is always responsible for reviewing Customer's online forms whenever any change is made, regardless of who makes the change. Customer is responsible for confirming that the online form presented to Users is accurate.

Usage

You indemnify, hold harmless, and promise not to sue Web Waiver, any related entities, or any associated persons / representatives / agents from any and all liabilities or claims made as a result of usage of this service, whether caused by the negligence or otherwise. You acknowledge that Web Waiver, any related entities, or any associated persons / representatives / agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf.

You understand that Web Waiver uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service. You agree not to copy, sell, or resell the Web Waiver service.

Web Waiver does not warrant that the service will meet your specific requirements, the service will be uninterrupted, timely, secure, or error-free, the results that may be obtained from the use of the service will be accurate or reliable, the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and any errors in the Service will be corrected.

Technology variations on devices and browsers can impact the accuracy of certain features such as digital signature pads. Customer is responsible for confirming accuracy of submitted data when submitted.

You expressly understand and agree that Web Waiver shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, resulting from: the use or the inability to use the service; the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; unauthorized access to or alteration of your transmissions or data; statements or conduct of any third party on the service; or any other matter relating to the service.

Setup and Support

Web Waiver offers setup and support, free of charge in many cases. You are responsible for reviewing and confirming content on any and all waivers that Web Waiver assists or created on your behalf. Web Waiver is not liable for typos, errors, or ommissions that may result from assistance, setup, or support.

Service Availability

A complete internet connection is required to utilize WebWaiver.com and its service. Web Waiver makes no guarantee of service availability.

Submitted Waiver Availability

Some regulations, laws, acts, or rules require that electronically signed documents be available to all related parties in order to be valid. Submitted waivers are available through the WebWaiver.com web site to customers in good standing and current on invoice payment. It is the responsibility of the customer to make any party's submitted waiver available on demand to that party. Failure to make available the submitted waiver to both party's can result in the electronic document being considered invalid. WebWaiver provides a process for both account holders and non account holders to find submitted waivers. In some cases, WebWaiver.com may charge standard paralegal rates for research and investigation requests.

Waivers for inactive accounts will be removed and archived in deep storage. Requests for retrieval from deep storage will be handled in order of priority and be subject to retrieval fees starting at $200.

Waivers for active accounts will be moved to cold storage after one year. Request for retrieval from cold storage will be handled in order of priority and be subject to retrieval fees starting at $100.

Compliance

WebWaiver voluntarily strives to maintain compliance with common rules, regulations, acts, and laws. Common rules, regulations, acts, and laws are subject to change. WebWaiver does not warrant that the service will meet customer specific requirements or be compliant with customer specific rules, regulations, acts, and laws. WebWaiver is not a legal organization and does not provide legal guidance or advice. WebWaiver encourages all customers to seek legal counsel for their jurisdiction regarding compliance with customer specific rules, regulations, acts, and laws. WebWaiver strives to provide accurate information, but shall not be liable for information inaccuracies provides on the site.

Compliance with local security or privacy regulations

Although WebWaiver voluntarily strives to maintain compliance with common rules, regulations, acts, and laws, customer bears the responsibility to ensure that their usage of WebWaiver services do not violate any applicable local or global regulations. Customer may not request personal government or financial information such as government issued numbers or credit card numbers on their forms.
