Description of Activity and Risks
Pole fitness involves various physical activities such as spins, climbs, inversions, off-the-pole dance, and floor work. These activities carry inherent risks, including but not limited to muscle strains, fractures, falls, and other injuries. Cardiovascular complications may also be a concern.

Before engaging in pole fitness, participants should consult with a physician to ensure they are fit for exercise. Individuals should be in good physical condition and free from medical conditions that could be aggravated by participation. Any relevant health conditions should be disclosed to the instructor prior to each class.


Acknowledgement & Assumption of Risk
Pole fitness carries inherent risks, including the risk of serious injury or even death. The physical demands of the activity may also exacerbate existing medical conditions. Participation is voluntary and occurs at the participant’s own risk.

Potential hazards include, but are not limited to, falls, sprains, fractures, concussions, and other severe injuries. Risks may also arise from the actions (or inactions) of others, the use of equipment, facility conditions, or inadequate emergency response.

By participating, individuals voluntarily accept all risks associated with pole fitness classes, including injury, death, or property damage. The instructor may provide physical adjustments or spotting to ensure safety and proper technique.

Waiver and Release of Liability
By participating in Trixie Vi Pole Fitness classes, the participant agrees to release and discharge Theresa Villamiel (instructor) and Misfit Aerial, LLC (studio) and its staff (collectively referred to as the "Released Parties") from any and all claims, liabilities, or causes of action arising from injury, illness, or damage that may result from participation, including those caused by negligence. The participant waives any right to bring legal action against the Released Parties for personal injury, property damage, or any other related claims.


Indemnification
The participant agrees to indemnify and hold the Released Parties harmless from any claims, demands, or expenses, including legal fees, that may arise from their participation in pole fitness classes or from any violation of this agreement.


Rules and Policies
All rules and policies of Trixie Vi Pole Fitness/Theresa Villamiel 
(instructor) and Misfit Aerial, LLC must be strictly followed. Failure to do so may result in removal from class without a refund. Key policies include:

Participants must be at least 18 years old.

Avoid using lotions or oils 24 hours before class.

Remove all jewelry before participating.

Inform the instructor of any health issues or injuries before class.

Arrive early to allow time for warm-up.

Participants under the influence of drugs or alcohol will be asked to leave.

The studio is not responsible for lost or stolen items.

Payment is due before the start of class.


Photo and Video Release
By participating in classes, the participant grants permission for Trixie Vi Pole Fitness/Theresa Villamiel 
(instructor) to use their likeness (name, photos, videos, and stories) for marketing and promotional purposes without compensation. The participant waives any related rights and releases the studio from any claims arising from the use of their image or likeness. If the participant prefers not to have their image used publicly, they must notify the studio staff in advance.


Late Cancellation and Late Arrival Policy

24-Hour Cancellation Policy: A minimum of 24 hours' notice is required for cancellations or rescheduling.

Late Arrival Policy: Participants who arrive more than 10 minutes late may not be allowed to join the class for safety reasons.

Exceptions: Exceptions may be made in cases of verifiable emergencies. Please contact the instructor as soon as possible in such cases.


Acknowledgment
By signing this agreement, the participant acknowledges that they have read, understood, and agree to the terms outlined above. The participant understands that by signing, they are waiving significant rights and are voluntarily releasing the Released Parties from liability to the fullest extent permitted by law.
