Studio Policies & Acknowledgment of Risk
Membership Commitment
Introductory Offers: Intro offers may only be used one time per person. Offers are only valid for new members or for those who have not attended a class at Studio Chrome within 6 months prior to purchasing the Intro offer. There are no refunds or extensions given.
Single Classes: Single Classes are good for the class you sign up for. They do not guarantee your spot in any future classes. No refunds will be given for cancellations or otherwise. Transfers are at the discretion of Studio Chrome.
Series: Series are defined as consecutive weekly classes. You are committed to the session you sign up for and there are no makeups for missed classes. For example, a 5 class series starting January 1st would run January 1/1, 1/8, 1/15, 1/22, 1/29. No refunds will be given, transfers are at the discretion of Studio Chrome.
Private Lessons: Will be reserved following a non-refundable 50% deposit with remaining balance due the day of or prior to your lesson. No refunds will be given, transfers are at the discretion of Studio Chrome.
Parties: Will be reserved following a non-refundable 50% deposit with remaining balance due the day before the day of the party. All party attendees and participants must sign this Waiver of Liability. No refunds will be given, transfers are at the discretion of Studio Chrome.
Cancellations: No refunds or rescheduling will be given for missed or cancelled classes. In the event Studio Chrome cancels a class, a future class date and time will be provided.
Payments
Payments must be made in full prior to start of classes and are non-refundable.
Studio Policies
Member agrees to conform to and be bound by the policies of Studio Chrome. Studio Chrome reserves the right to terminate this agreement at any time, with or without notice and will not be required to refund any unused portion of prepaid fees collected on behalf of this agreement. Membership may not be shared. All members will maintain a respectful disposition of the studio rules, equipment, and studio members, and instructors. No alcohol, drugs, or smoking is permitted. Students must be free of any substance that may impair their judgment and/or ability to safely perform and participate in pole fitness moves, classes, workshops, rehearsals, performances, and open gym. Studio policies apply to all classes and events held at Studio Chrome. Studio Chrome has zero tolerance for harassment of any kind. Any comments or actions deemed offensive, inappropriate, or offensive are grounds for membership termination and will follow the terms of this agreement. In the event of an emergency closing due to unforeseen circumstances including but not limited to illness, weather, and studio repairs, makeup classes are at the discretion of Studio Chrome. Member agrees to be liable for any attorney fees associated with any efforts by Studio Chrome to collect owed and outstanding payments.
Liability
I understand and agree that in participating in any classes, dance, workshop, rehearsal or performance, there is a possibility of physical injury or death. Member recognizes that there are hazards and risks connected with physical fitness training. These risks include, but are not limited to, abnormal blood pressure, fainting, heart disorders and heart attack, dehydration, heat exhaustion, sprains, muscle strain, blisters, stress fracture, shin splints, forearm splints, tendonitis, cartilage tears, bursitis, back pain and bruising of joints. Exercise beyond one's physical limits and/or accidents involving exercise equipment may result in serious injury or even death. Member agrees to defend, indemnify and hold harmless Studio Chrome against any loss, damage or expense incurred by reason of any claim or liability based upon personal injury (including death) or property damage arising out of the negligent or intentional action of Member. Member further agrees to release Studio Chrome and its owners, officer, agents, employees and/or affiliates from any and all liability arising out of injury to Member, and further agrees to defend, indemnify and hold Studio Chrome, its owners, officers, employees and/or affiliates free and harmless from against the same. Member acknowledges that surveillance cameras are in use for the protection of the Facility, its equipment and its members. Member hereby consents to being photographed and/or recorded for such purposes. I voluntarily agree, therefore, to assume all risks and responsibility for any such injury and/or accident, which might occur to me or any child during any of the classes, dances, workshops, rehearsals, performances, or any related activities at Studio Chrome. I also exempt, release and indemnify Studio Chrome, its owners, agents, volunteers, assistants, employees, guest artists, faculty members, family, and/or students from any and all liability claims, demands, or causes of action whatsoever from any damage, loss, injury, or death to me, my children, or property which may arise out of or in connection with participation in any classes or activities conducted by Studio Chrome. I agree to get a full medical exam at my own cost prior to starting my membership and immediately terminate my membership with Studio Chrome if medical conditions prevent me from exercising and/or with a doctor’s recommendation. I further hereby voluntarily agree to waive any rights and that of my heirs' and assigns to exempt Studio Chrome, its owner, agents, volunteers, assistants, employees, guest artists, faculty members, family, and/or students liable from such damage, loss, injury or death. I understand that I should be aware of my physical limitations and agree not to exceed them. I agree to never perform or attempt anything that was not already taught and improved by an instructor. I will never perform movements or skills without proper spotting, safety equipment, and permission from an instructor.
NON-COMPETE DISCLOSURE
I acknowledge that all class content, including but not limited to teaching method, curriculum, class descriptions, class names, discussions, written materials, movements, dance steps, routines, choreography and scenery (the “Proprietary Information”) are the property of Studio Chrome and constitute confidential and proprietary business information and trade secrets, the unauthorized disclosure of which will irreparably harm Studio Chrome. I further agree that in exchange for Studio Chrome agreeing to take me on as a student, I agree to keep the Proprietary Information confidential and that I will not disclose the Proprietary Information to anyone without the prior written consent of Studio Chrome. I further agree that I will not teach to any third party any of the Proprietary Information, and that I will refer any person wishing to learn any of the Proprietary Information to Studio Chrome. I further expressly agree that I will not use the Proprietary Information for the purpose of soliciting any students or employees of Studio Chrome or to otherwise compete with Studio Chrome.
By signing below I agree for up to one (1) year following my last lesson or class at Studio Chrome. I will not directly or indirectly, solicit the trade of, or do business involving Pole Dance, Pole Fitness, and/or Exotic Dance within twenty five miles (25) of Studio Chrome business operations in New York State other than for the benefit of Studio Chrome under penalty of paying financial damages to Studio Chrome in the amount of $799 or the current cost of Studio Chrome's Instructor Certification training.
