ROCK VALLEY CLIMBING DISCLAIMER AGREEMENT


Between Rock Valley Climbing (PTY), hereafter referred to as

RVC

And The Climber, or any person entering RVC, hereafter referred to as

Climber

RVC and the Climber have entered into an agreement in terms whereof RVC has allowed the Climber to make use of its facilities on the terms and conditions below.

The Climber understands that participation in, or observing of the sport of rock climbing and the use of RVC’s indoor climbing wall includes certain dangers and risks:

  • Injury sustained in a fall and hitting the wall, projections (permanent or temporary in place) the floor (including any object or objects resting on the floor).
  • Injury due to falling climbers or objects.
  • Cuts and abrasions resulting from bodily contact with the climbing wall.

The Climber further acknowledges that this list is not inclusive of all possible risks and dangers associated with the use of the indoor climbing facility.

The ability of the Climber to climb at RVC gives no indication of his/her ability to climb on natural rock in an outdoor environment.

THEREFORE IT IS AGREED UPON AS FOLLOWS:

WAIVER

The Climber acknowledges that the activity in which he/she participates in by its very nature dangerous and carries inherent risks. Best effort done on the part of RVC staff and owners cannot completely reduce the possibility of such risks. These risks could cause him/her to sustain bodily injury or death and/or suffer damages and the Climber waives any claim however arising against RVC or its members, employees, the body corporate of Telford Place or any third party.

DISCLAIMER

The Climber makes use of RVC's facilities at entirely his/her own risk. The Climber agrees that RVC will not be held liable and/or responsible for any loss, injury, damages, death, and/or compensation of whatsoever nature and howsoever arising as a result thereof.

We will not be responsible for, and shall not pay for, any loss, damage or theft of items left unattended.

MEDICAL FITNESS

The Climber hereby warrants that he/she is medically fit so as to participate in activities of this nature, it not being the responsibility of RVC to have the Climber undergo any medical examination, the onus being on the Climber to do so. RVC shall not be obliged to call upon the Climber to provide a medical certificate. RVC, its members or employees, shall not be held liable for any claim or injury or loss, damage or even death arising from or in connection with the use of the facility.

PARENTS OR GUARDIANS ADDITIONAL INDEMNIFICATIONS (MUST PLEASE BE COMPLETED FOR ALL PARTICIPANTS UNDER THE AGE OF 18):

(“Minor”) being permitted by Rock Valley Climbing to utilise its facilities, the Climber / Guardian hereby irrevocably indemnify and hold harmless, Rock Valley Climbing and Proprietor, partner, directors, shareholders, members, employees, consultants, contractors, agents and or representatives against all and any claims, loss, demands, damages, liability, costs, and or expenses of whatsoever nature whether direct or consequential, including legal costs as between attorney and client which the Climber / Guardian may suffer or sustain as a result of or which may be attributable to any action and or omissions, whether negligent (excluding gross negligence as envisioned in the CPA) of Rock Valley Climbing partners, directors, shareholders, members, employees, consultants, contractors, agents and or representatives in connection with the use or participation b Minor of any of Rock Valley Climbing’s facilities.

By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
