RedDot axehouse LLC, for themselves, their present and former parent, subsidiaries, affiliates and related companies and each of their respective present and former directors, officers, shareholders, employees, volunteers, servants, agents, administrators, trustees, successors and assigns and any party or parties who claim a right or interest through them (hereinafter, the “Releasees”); Recreational Axe-Throwing (the “Activity”) This Participation Agreement and Waiver and Release of Liability is entered into between the undersigned “Participant” and RedDot Axe House, LLC. and its Releasees. Participation in the activities of RedDot Axe House, LLC can be HAZARDOUS AND PRESENT A DANGER TO PARTICIPANT. If at any time the Participant/ Guardian believes conditions to be unsafe, they will immediately discontinue further participation in the Activities. The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law; it will be governed by applicable local Laws and any dispute arising from this Release of Liability, Waiver, and Assumption of Risk will be adjudicated by the State of Georgia. I UNDERSTAND THAT I AM RESPONSIBLE FOR THE WHEREABOUTS AND SUPERVISION OF THE LISTED MINOR AT ALL TIMES. I acknowledge that this activity may involve a test of a person's physical and mental limits and carries with it the potential for death, serious injury, and property loss. I certify that the participant/minor is physically fit and has not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems that preclude the participant/minor’s participation in this activity. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity in which the participant/minor may participate, and that it will govern my/the minor’s actions and responsibilities at said activity. In consideration of my application and permitting the minor to participate in this activity, I hereby take action for the minor, their executors, administrators, heirs, next of kin, successors, and assigns as follows: (A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for the participant/ minor’s death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to the minor including their traveling to and from this activity, THE FOLLOWING ENTITIES OR PERSONS: RedDot Axehouse, LLC. and its Releasees, NOW AND/OR IN THE FUTURE. (B) INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in (A) paragraph from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise; from any liability, litigation expenses, attorney fees, losses, damages or costs any may incur as the result of any such claim, whether asserted by the undersigned, the participant, or another person; I acknowledge that RedDot AXEHOUSE , LLC. and its Releasees are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf. The risks include, but are not limited to, those caused by terrain, property, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, monitors, and/or producers of the activity. These risks are not only inherent to participants, but are also present for volunteers. Some risks cannot be predicted or controlled. There may be other risks and social and economic losses either not known to me or not readily foreseeable at this time. I hereby consent to receive medical treatment for the minor that may be deemed advisable in the event of injury, accident, and/or illness during this activity. (C) SEVERABILITY: If any provision of this document is determined to be invalid for any reason, such invalidity shall not affect the validity of any of the other provisions, which other provisions shall remain in full force and effect as if this document had been executed with the invalid provision eliminated. PHOTOGRAPHS, VIDEOS AND RECORDINGS: I understand that while participating in this activity the participant/minor may be photographed. I agree to allow their photo, video, or film likeness to be used for any legitimate purpose by the activity holders, producers, sponsors, organizers, and assigns, INCLUDING SOCIAL MEDIA.​ I release all photos taken of the participant/ minor​ at RedDot Axe House, LLC. I acknowledge that RedDot Axe House, LLC will own such “Images”​ and further grant RedDot Axe House, LLC permission to copyright, display, publish, distribute, use, modify, print and reprint such Images in any manner whatsoever related to RedDot Axe House, LLC business, including without limitation, publications, advertisements, brochures, web site images, or other electronic displays and transmissions thereof. I further waive any right to inspect or approve the use of the Image by RedDot Axe House, LLC prior to its use. I forever release and hold RedDot Axe House, LLC harmless from any and all liability arising out of the use of the Images in any manner or media whatsoever, and waive any and all claims and causes of action relating to use of the Images, including without limitation, claims for invasion of privacy rights or publicity. EMAIL ADDRESS:​ By providing my e-mail address, I am opting into the e-mail list. My e-mail address may be used to contact me, but will not be made available to third parties. E-mails may be sent monthly to quarterly. LOST/ STOLEN ITEMS: We are not responsible for lost or stolen items.​ PARKING: We are not responsible for damage to vehicles or stolen vehicles. I release RedDot Axe House, LLC and its Releasees from any injuries incurred from any animals on the premises. I, THE UNDERSIGNED GUARDIAN, HEREBY CERTIFY THAT I AM AT LEAST 18 YEARS OLD AND TAKE FULL RESPONSIBILITY FOR THE MINOR LISTED; THAT I HAVE COMPLETELY READ AND UNDERSTAND THIS AGREEMENT AND ITS TERMS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL; THAT PRIOR TO SIGNING THIS AGREEMENT, I WAS GIVEN THE OPPORTUNITY TO ASK ANY QUESTIONS ABOUT THIS AGREEMENT; THAT BY SIGNING THIS AGREEMENT I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THIS EVENT. I WAIVE AND RELEASE CERTAIN RIGHTS THAT I AND EACH OF MY AND THE MINOR’S HEIRS, NEXT OF KIN, FAMILY, RELATIVES, GUARDIANS, CONSERVATORS, EXECUTORS, ADMINISTRATORS, TRUSTEES AND ASSIGNS MAY HAVE AGAINST RELEASEES
