RELEASE OF LIABILITY, INDEMNITY, ASSUMPTION OF RISK & MARKETING WAIVER

(Valid for the event selected below and future events as outlined herein)

IN CONSIDERATION of being permitted to participate in or assist with any INDY BLAST event or activity—including but not limited to Laser Tag, Nerf, Gel Blaster, Foam Parties, and related games or attractions—operated by INDY BLAST LLC, whether as a participant, volunteer, event helper, or in any other capacity, I acknowledge and agree as follows:

1. Assumption of Risk

I fully understand and acknowledge that:
(a) Participation in Indy Blast activities involves known and unknown risks, including but not limited to bodily injury, illness, strain, partial or total paralysis, eye injury, blindness, heat stroke, heart attack, or death;
(b) These risks may be caused by my own actions or inactions, those of other participants, or the negligence of INDY BLAST, its owners, agents, or employees; and
(c) I voluntarily assume all such risks and responsibility for any losses, costs, or damages I may incur as a result of participating.

2. Release and Indemnification

I, on behalf of myself, my personal representatives, heirs, and assigns, voluntarily release, waive, discharge, and agree to indemnify and hold harmless INDY BLAST LLC dba INDY BLAST, its owners, agents, employees, contractors, and affiliates from any and all claims, actions, liabilities, losses, or damages for bodily injury, illness, death, or property damage arising from my participation in or assistance with any INDY BLAST event or activity, including those arising from the alleged or actual negligence of INDY BLAST or otherwise.

This waiver and release applies to all activities associated with INDY BLAST events, whether I am participating, volunteering, assisting, or present in any capacity.

3. Waiver Validity and Scope

This waiver applies to the event selected below and any future INDY BLAST events or activities, including presence on or around event premises, attended within 24 months of the signature date, regardless of any errors or omissions in event selection. A new waiver may be required at INDY BLAST’s discretion for certain events or venues.

4. Participant Supervision

For private events, a parent or guardian must provide adequate supervision for all participants under the age of 18 unless other adult supervision has been arranged by the event organizer and approved in advance by INDY BLAST. In drop-off or group events (such as schools, camps, or youth programs), the hosting organization or its designated staff are responsible for participant supervision during the event.

5. Responsibility for Equipment Damage or Loss

I understand and agree that I (or my child, if under 18) am responsible for any INDY BLAST equipment that is intentionally, maliciously, or negligently damaged, lost, or stolen during the event or after the event while under my control or supervision.

I further agree to reimburse INDY BLAST for the reasonable cost of repair or replacement, as determined by INDY BLAST. I acknowledge that this responsibility applies whether the damage is caused directly by myself, my child, or results from failure to follow INDY BLAST staff instructions or safety rules.

6. Photo and Video Release

I understand and agree that photographs and video recordings may be taken during INDY BLAST events.  Participation in any INDY BLAST activity constitutes consent for INDY BLAST to use these photos or videos for lawful marketing, advertising, or social media purposes without compensation.
I understand that this consent is included as a condition of participation in all Indy Blast activities.

7. Acknowledgment of Understanding

By signing below, I confirm that I have read this waiver in its entirety, understand its terms, and sign it voluntarily.

I acknowledge that this document releases INDY BLAST from liability for injury, illness, or death caused by negligence or any other cause.

I understand this waiver is intended to be as broad and inclusive as permitted by the laws of the State of Indiana.

By signing below, I confirm that I have read and agree to the Indy Blast Universal Waiver.  If I am signing as a parent or guardian, my signature applies to my child’s participation as well as my own (if participating).
