In consideration of the undersigned Participant being allowed to enter and use the play area, and/or participate in any party and/or program at Hop Hop. I affirmatively represent the following: 

• 1) I represent that I am the parent or legal guardian of the Participant(s) named below or I have obtained permission from the parent/legal guardian of the Participant(s) named below to execute this agreement on their behalf. I am of physically ability to participate and am legally competent to understand and complete this agreement. I hereby execute this agreement without concern;

• 2) I waive any and all claims for personal injury including death, illness, and/or property damage that either the Participant or I may have against Hop Hop, its principals, directors, employees, representatives and volunteers in any way associated with Hop Hop. I further release all the foregoing individuals and entities from any and all liability for any loss, damage, injury, death, medical or other expense that the Participant or I may suffer, or that any other party may suffer, as a result of either the Participant's or my use of the Hop Hop facility;

• 3) I waive any and all claims for personal injury including death, illness, and/or property damage that either the Participant or I may have against Hop Hop, its principals, directors, employees, representatives and volunteers in any way associated with Hop Hop. I further release all the foregoing individuals and entities from any and all liability for any loss, damage, injury, death, medical or other expense that the Participant or I may suffer, or that any other party may suffer, as a result of either the Participant's or my use of the Hop Hop facility;

   

• 4) I agree to hold harmless and indemnify the Hop Hop, and all the individuals named in paragraph 3 above, from any claim, liability, or suit alleging property damage or personal injury to any third party, resulting from either the Participant's or my use of the Hop Hop facility;

   

• 5) The release, waiver, and indemnity contemplated herein shall be binding on my next of kin, heirs, executors, administrators, successors and assigns. Further, this release, waiver and indemnity shall survive the date(s) of Participant(s) and/or my use of the facility;

   

• 6) I hereby certify that the Participant is covered by his/her own medical insurance and that I have read and understand this document prior to signing it, and that I am aware that by signing this document I am waving certain legal rights that the Participant or I may have. Should either the Participant or I have any physical limitation or condition that creates the potential for a higher risk of injury while enjoying the Hop Hop facility, I agree to inform Hop Hop personnel of such limitation or condition in advance of gaining entry to the facility.

   

• 7) The representations made above are material in nature. I recognize that Hop Hop is relying upon the material representations in determining whether the Participant and/or I should be permitted to gain entry to and use of the Hop Hop.

• 8) I understand that entry, by myself and the participant(s) named, constitutes consent for Hop Hop to use any film, video, or likeness of participants for any purpose whatsoever, without payment to the participant.

• 9) Severe acute respiratory syndrome coronavirus 2 (“SARS-CoV-2”), which is responsible for Coronavirus Disease (collectively “COVID-19”), has been declared a worldwide pandemic by the World Health Organization. COVID-19 is highly contagious and is believed to spread mainly from person-to-person contact. Our facility has put in place preventative measures intended to reduce the spread of COVID-19 and minimize the risk of infection to the same; however, we cannot guarantee that you, your child(ren), family, friends or others will not become exposed to, or infected with COVID-19 and/or any mutation or variation thereof while attending or participating in activities at Hop Hop facility. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren), myself and others may be exposed to or infected by COVID-19 by participating in, or attending play activities, and that such exposure or infection may result in personal injury, illness, permanent disability, or death. I further understand that the risk of becoming exposed to or infected by COVID-19 during your stay in our facility may result from the actions (negligent or not) of myself and others, including, but not limited to, Hop Hop, its directors, officers, members, employees, agents, representatives and other participants within your group. Additionally, by signing this agreement, I voluntarily agree to assume all of the previously mentioned risks and accept sole responsibility for any injury to my child(ren) or myself, illness, death, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s participation in activities at Hop Hop's. On my behalf, and on behalf of my child(ren), I hereby release, pledge not to sue, and hold harmless Hop Hop and its employees, of any and all claims, including all liabilities, actions, damages, costs or expenses of any kind arising out of or relating to exposure or contraction of COVID-19 and/or any mutation nor variation thereof. I understand and agree that this release includes any claims based on the actions (negligent or not) of Hop Hop, its directors, officers, members, employees, agents, representatives and other participants within your group, regardless of whether a COVID-19 infection occurs before, during, or after participation in any activity at Hop Hop's facility.
