Guest has never been convicted of a felony or any crime involving domestic violence.
Guest is not prohibited from possessing a firearm by any state or federal law.
Guest is not under the influence of drugs, alcohol, or any other substances that impair my ability to participate in activities on the premises.
Guest will act in a sportsmanlike and respectful manner toward all guests, participants, staff, agents, and any other persons affiliated with Landowner, its affiliates, and personnel.
Guest agrees to follow all safety rules and instructions provided by Gregorie Neck Plantation staff or any authorized personnel.
Guest acknowledges that Landowner reserves the right to terminate any activity at any time for any reason and may ask guests to leave the premises immediately if these rules are not followed.
2. ASSUMPTION OF RISK AND RELEASE OF LIABILITY For the purposes hereof, the “Activities” shall mean any recreational undertaking including without limitation, any activities or endeavors related to hunting, horseback riding, hiking, weapon discharge or handling, firearm shooting (including rifles, shotguns, and handguns), operation of motorized vehicles, ATVs and Motorcycles, animal interaction (including wildlife and domestic animals), cooking and any and all other outdoor activities and equipment used in connection with these activities or in any way relating to the above activities and endeavors, nature, or the outdoors. Guest acknowledges and understand that participating in Activities at Gregorie Neck Plantation involves inherent risks of injury, property damage, and even death. Guest assumes full responsibility for these risks and agree that these risks cannot be eliminated despite the implementation of safety measures. In consideration of being allowed to enter and participate in Activities at Gregorie Neck Plantation, Guest hereby:
Waives, releases and discharges waives for his executors, administrators, assignees or heirs, any and all rights and claims for damages, losses, demands and any other actions whatsoever, which he, individually or in solido, may have or which may arise against Landowner, and its affiliates, Gregory Neck Cattle Company, LLC, Lane Scott Holdings, LLC, and their respective its members, managers, officers employees or agents and any of their executors, heirs or assigns (collectively “Released Parties”), including but not limited to any and all injuries, damages or illnesses suffered by Guest and/or Guest’s property, which may, in any way whatsoever, arise out of, be related to or be connected with the Activities or in any way connected with his presence on the property of Landowner, except those arising from the sole gross negligence or willful misconduct of the Released Parties. Guest on behalf of Guest and Guest’s executors, administrators, assignees or heirs, hereby expressly release Released Parties and any of their heirs, employees, directors, officers or agents from any and all such claims. Guest understands and agrees that this release is intended to be as broad and inclusive as permitted by the laws of the State of South Carolina, and that if any portion is held invalid, the balance shall continue in full legal force and effect.
Indemnifies, holds harmless and defends, Released Parties from any and all fault, liabilities, costs, expenses, claims, demands or lawsuits arising out of, related to or connected with the Activities on the Property, including without limitation the discharge of firearms, use of and presence on land of the Landowner, except those arising from the sole gross negligence or willful misconduct of Released Parties. Should any such claim, demand or lawsuit arise or be asserted in any way whatsoever related thereto, whether arising under the laws of the United States, any state, or under any theory of law or equity, Guest will indemnify, hold harmless and defend Released Parties, from any and all costs, expenses or liability including, but not limited to, the cost of any settlement or judgment made or rendered against Released Parties, whether individually, jointly, or in solido with Guest, together with all costs of court and other costs or expenses incurred in connection with any such claim, demand or lawsuit, including attorney's fees.
Indemnifies, holds harmless and defends, Released Parties against any claims, damages, or losses caused by my actions or omissions or those of persons affiliated with Guest.
Expressly assumes the risk of entering the land of Landowner and of taking part in the Activities at Gregory Neck Plantation which include, but are not limited to, the discharge of firearms and the firing of live ammunition and use thereof and presence at Gregory Neck Plantation.
3. EMERGENCY MEDICAL TREATMENT AUTHORIZATION
Guest authorizes Landowner to provide emergency medical treatment in the event of an injury or medical emergency. Guest understands that Guest will be responsible for any medical expenses incurred as a result of such treatment.
4. PHOTOGRAPHIC AND VIDEO RELEASE Guest understand that the Released Parties may take photographs or video recordings during the Activities. Guest hereby grants the Released Parties the right to use, reproduce, and distribute any photographs or video recordings of me for promotional, marketing, or any other lawful purposes without compensation to me.
5. COMPLIANCE WITH LAWS
Guest agrees to comply with all applicable laws, including those of the State of South Carolina, and any additional rules, regulations, or safety instructions provided by Landowner or its authorized personnel.
6. EXCLUSION OF LIABILITY FOR GROSS NEGLIGENCE
The provisions of this agreement shall not apply in cases of gross negligence, willful misconduct, or any unlawful acts committed by Release Parties
7. LEGAL EFFECT AND ENFORCEABILITY
Guest understands that by signing this agreement, Guest is waiving substantial legal rights, including the right to sue Released Parties. This waiver is enforceable under the laws of the State of South Carolina. If any provision of this waiver is found to be invalid, the remaining provisions will remain in full force and effect.
8. ENTIRE AGREEMENT AND MODIFICATIONS
This Agreement constitutes the entire understanding between the undersigned and Landowner. Any modifications must be made in writing and signed by both parties.
9. SIGNATURE AND ACKNOWLEDGMENT
By signing below, Guest confirm that I have read and fully understand this Guest Authorization Agreement and the risks involved in participating in activities at Gregorie Neck Plantation. Guest acknowledges that Guest is signing this document voluntarily and that no other representations have been made to me.
